LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session March 26, 1995 TO: Honorable Hugo Berlanga, Chair IN RE: House Bill No. 2383 Committee on Public Health By: McDonald House of Representatives Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on House Bill No. 2383 (Relating to the regulation of retail food stores, food service establishments, mobile food units, and roadside food vendors.) this office has determined the following: The bill would include municipalities under certain requirements relating to the regulation of retail food stores, food services establishments, mobile food units, and roadside food vendors. Local units of government would be affected by this bill, which would require them to only expend funds collected in food regulation for food regulation purposes. Further, municipalities, like counties and public health districts, would not be permitted to charge fees that would generate revenue in excess of the costs necessary to administer the regulatory program. However, the fiscal implications of these provisions cannot be determined. No fiscal implication to the State is anticipated. The fiscal implication to units of local government cannot be determined.
