TO: Honorable Senfronia Thompson, Chair IN RE: House Bill No. 2398
Committee on Judicial Affairs By: Thompson
         House of Representatives
         Austin, Texas

FROM: John Keel, Director

In response to your request for a Fiscal Note on House Bill No.
2398 (relating to duties of the district clerk) this office has
determined the following:

The bill would eliminate the report filed on the last day of each
term by the district clerk reporting the fines and jury fees
received during the term of the court and amounts paid to the
jurors. The bill would increase fees for issuing a subpoena from
$4 to $8, create fees for a petition for pre-indictment writ of
habeas corpus ($45), a third party petition ($15) and would cap
the cost of a non-certified copy of at $1. The bill would
eliminate certain other fees and would provide that the $20 jury
fee, which currently applies only to counties with a population
exceeding 2 million, would apply to all counties in Texas.

No fiscal implication to the State is anticipated.

The fiscal implication to units of local government cannot be
determined.
