TO: Honorable Steve Holzheauser, Chair IN RE: House Bill No. 2520
Committee on Energy Resources By: Horn
         House of Representatives
         Austin, Texas

FROM: John Keel, Director

In response to your request for a Fiscal Note on House Bill No.
2520 (Relating to the sale of certain motor fuel; providing
criminal and civil penalties.) this office has determined the
following:

The bill would make no appropriation but could provide the legal
basis for an appropriation of funds to implement the provisions
of the bill.

The bill would transfer the responsibility of administering,
testing and enforcing provisions relating to the sale of motor
fuels from the Comptrollers Office to the Commissioner of
Agriculture. The Commissioner of Agriculture would administer
and enforce rules relating to an automotive fuel rating program.
The Comptrollers Office would still set and collect fees and
penalties imposed by the provisions.

No significant fiscal implication to the State is anticipated.

No fiscal implication to units of local government is
anticipated.
