TO: Honorable Clyde Alexander, Chair IN RE: House Bill No. 2584
         Committee on Transportation By: Alexander
         House of Representatives
         Austin, Texas

FROM: John Keel, Director

In response to your request for a Fiscal Note on House Bill No.
2584 (Relating to the weight of vehicles transporting recyclable
materials.) this office has determined the following:

The bill would make no appropriation but could provide the legal
basis for an appropriation of funds to implement the provisions
of the bill.

The bill would allow vehicles, other than tractor-trailor
combination vehicles, equipped with container roll-off units and
exclusively transporting recyclable materials, to be operated on
the public streets and highways of the State. The owner, except
if the owner is a municipality, of said vehicle shall first file
with the State Department of Transportation a surety bond in the
principal sum, as fixed by the Department, not to be greater than
$15,000 for each vehicle. Any person, corporation, or receiver
who violates any provision of the Act would, upon conviction, be
punished by a fine and for subsequent convictions, increased
fines and imprisonment.

The Department of Transportation has indicated costs associated
with the bill are indeterminable at this time.

The fiscal implication to the State or units of local government
cannot be determined.
