LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session May 9, 1995 TO: Honorable Curtis Seidlits, Chair IN RE: Committee Substitute Committee on State Affairs for House Bill House of Representatives No. 2646 Austin, Texas By: Bosse FROM: John Keel, Director In response to your request for a Fiscal Note on House Bill No. 2646 (relating to courts of inquiry under the Code of Criminal Procedure) this office has determined the following: The bill would remove Chapter 52 of the Code of Criminal Procedure, concerning Courts of Inquiry. Under the existing statute costs are borne by the county in which the Court of Inquiry is conducted unless the Attorney General has submitted a request to the judge for the holding of the Court of Inquiry, in which case the costs are borne by the State. The removal of the statute authorizing Courts of Inquiry could result in savings to the State or units of local government. However, because the convening of a Court of Inquiry occurs infrequently these savings are expected to be significant. Source: Legislative Budget Board LBB Staff: JK, DC, DF
