In response to your request for a Fiscal Note on House Bill No.
2891 (Relating to reports to the legislature by state health and
human services agencies and to the long-term care state plan for
the elderly.) this office has determined the following:

The bill would make no appropriation but could provide the legal
basis for an appropriation of funds to implement the provisions
of the bill.

The bill addresses a number of reporting requirements for certain
state agencies.

In addition, the bill would repeal the requirement that the
Department on Aging prepare a long-term care state plan for the
elderly and  require the Health and Human Services Commission to
revise, update and review the implementation of this plan.  HHSC
would  be required to submit biennial reports on the long-term
care plan to the Governor and the Legislature. 

The bill would also require the Department on Aging, Department
of Human Services, Department of Health, and Department of Mental
Health and Mental Retardation to adopt a memorandum of
understanding that clearly defines the responsibilities of each
agency in biennially revising and updating the Texas long-term
care state plan for the elderly.


No significant fiscal implication to the State or units of local
government is anticipated.
