TO: Honorable Rodney Ellis, Chair IN RE: Senate Bill No. 42,
      Committee on Intergovernmental as amended
      Relations By: Shapiro
      Senate
      Austin, Texas

FROM: John Keel, Director

In response to your request for a Fiscal Note on Senate Bill No.
42 (relating to access to criminal history record information by
certain organizations providing volunteer services) this office
has determined the following:

The bill would make no appropriation but could provide the legal
basis for an appropriation of funds to implement the provisions
of the bill.

The bill broadens the definition of a volunteer center.
Volunteer centers throughout the state would be granted access to
criminal history information at the Department of Public Safety.
The department would be authorized to charge volunteer centers a
fee sufficient to cover costs.

The probable fiscal implication of implementing the provisions of
the bill during each of the first five years following passage
is estimated as follows:

Fiscal Probable Cost Out Probable Revenue
Year of General Gain to General
Revenue Fund 001 Revenue Fund 001

          1996 $50,478 $50,478
          1997 42,813 42,813

          1998 42,813 42,813

          1999 42,813 42,813
          2000 42,813 42,813

Similar annual fiscal implications would continue as long as the
provisions of the bill are in effect.

No fiscal implication to units of local government is
anticipated.
