LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session March 21, 1995 TO: Honorable Judith Zaffirini, Chair IN RE: Senate Bill No. 96 Committee on Health & Human Services By: Moncrief Senate Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on Senate Bill No. 96 (Relating to mental health proceedings and the administration of psychoactive medications.) this office has determined the following: This bill amends the mental health code to clarify that the county or district attorney shall represent the state in medication capacity hearings; that refusal of medication initiates the physician petition for a medication capacity hearing; and clarifies that individuals committed under the Code of Criminal Procedures (section 46.02 and 46.03) can not access the medication capacity hearing process. No fiscal implication to the State is anticipated. The fiscal implication to units of local government cannot be determined.
