LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session April 5, 1995 TO: Honorable Bill Sims, Chair IN RE: Senate Bill No. 248 Committee on Natural Resources By: Bivins Senate Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on Senate Bill No. 248 (Relating to the seizure and disposition of certain property under the Parks and Wildlife Code.) this office has determined the following: The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill. The bill would amend Chapter 12 of the Texas Parks and Wildlife Code to establish a standard procedure by which the Department may keep, sell, or destroy confiscated property. It would also clarify when property may be retained by the Department and when it must be returned to the owner. While confiscations of property have not often proven to be marketable, Parks and Wildlife estimates that revenues of approximately $15,000 per year may be realized if confiscated equipment could be sold. The probable fiscal implication of implementing the provisions of the bill during each of the first five years following passage is estimated as follows: Fiscal Probable Revenue Year Gain to Account 009 1996 $15,000 1997 15,000 1998 15,000 1999 15,000 2000 15,000 Similar annual fiscal implications would continue as long as the provisions of the bill are in effect. No fiscal implication to units of local government is anticipated. Source: Parks and Wildlife Department LBB Staff: JK, PVT, DF
