FROM: John Keel, Director

In response to your request for a Fiscal Note on Senate Bill No.
431 (Relating to the punishment for certain criminal offenses
committed on the premises of a public transportation system and
the prohibition of consumption of alcoholic beverages on the
property of certain metropolitan transit authorities.) this
office has determined the following:

The bill would amend Chapter 12 of the Penal Code by increasing
the punishment prescribed to the next highest category for
certain offenses if it is shown at the trial that the offense
occurred on the premises of a designated recipient of mass
transit funds.

Provisions of the bill also allow an authority to prohibit the
consumption of alcoholic beverages on any real or personal
property under the possession or control of the department. Such
offenses would be punishable as Class C misdemeanors.

The fiscal implication to the State or units of local government
cannot be determined.
