LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session February 28, 1995 TO: Honorable Bill Sims, Chair IN RE: Senate Bill No. 650 Committee on Natural Resources By: Ratliff Senate Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on Senate Bill No. 650 (Relating to the regulation of nonpoint source water pollution, stormwater discharges, wet weather water quality standards and control of sanitary sewer overflows.) this office has determined the following: The bill requires that the Texas Natural Resource Conservation Commission (TNRCC) only adopt rules for nonpoint source pollution, stormwater discharges, wet weather water quality standards and sanitary sewer overflows that do not exceed federal requirements. The bill also requires that the TNRCC perform a legal analysis of proposed regulations to ensure that federal standards are not exceeded. The bill further requires that the TNRCC employ maximum flexibility in the implementation of associated regulations and allows local governments sufficient time to implement relevant programs. Local units of government may realize some cost savings under the provisions of the bill. However, the net fiscal implications for units of local government cannot be determined.
