                           FISCAL NOTE
                       74th Regular Session

                          April 26, 1995

TO: Honorable Clyde Alexander, Chair IN RE: Senate BillNo. 882,
         Committee on Transportation as engrossed
House of Representatives By: Sims, Ratliff
         Austin, Texas

FROM: John Keel, Director

In response to your request for a Fiscal Note on Senate Bill No.
882 (Relating to the placement of specific information logo signs
and major shopping area guide signs on certain public highways.)
this office has determined the following:

The bill would make no appropriation but could provide the legal
basis for an appropriation of funds to implement the provisions
of the bill.

The bill would amend Article 4477-9a V.T.C.S. by allowing
specific brand names of commercial establishments offering gas,
food, lodging, or camping to be placed along eligible highway
rights-of-way. The bill would require a major shopping area, as
defined by the Act, that has its name displayed on guide signs to
reimburse the Commission for all costs associated with the
composition, placement, erection, and maintenance of the sign.

The bill would deposit receipts under this section to the credit
of the State Highway Fund and exempt those receipts from Sections
403.094(h) and 403.095, Government Code.

The probable fiscal implication of implementing the provisions of
the bill during each of the first five years following passage
is estimated as follows:

Fiscal Probable Cost Out Probable Revenue
Year of State Highway Gain to State
                      Fund 006 Highway Fund 006

          1996 $68,576 $85,000
          1997 85,000

          1998 85,000

          1999 85,000
          2000 85,000

Similar annual fiscal implications would continue as long as the
provisions of the bill are in effect.

The fiscal implication to units of local government cannot be
determined.
