LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session March 28, 1995 TO: Honorable Bill Sims, Chair IN RE: Senate BillNo. 1017 Committee on Natural Resources By: Wentworth Senate Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on Senate Bill No. 1017 (Relating to the designation of water quality protection zones in certain areas.) this office has determined the following: The bill would establish voluntary "water quality protection zones" for continuous tracts of land greater than 1,000 acres in the extraterritorial jurisdiction of certain municipalities. The bill would require the Texas Natural Resource Conservation Commission (TNRCC) to review and approve within 120 days from the date filed, a water quality plan for each Water Quality Protection Zone. The bill authorizes the TNRCC to adopt and assess reasonable and necessary fees to recover the costs from administering the provisions of the bill. However, the number of water quality plans that might be filed with the TNRCC for review and approval cannot be determined. The bill would prohibit a specified municipality from enforcing any of its ordinances, rules or requirements including, but not limited to, pollution abatement regulations or plans, water quality ordinances, or subdivision requirements. The bill further prohibits a municipality specified in the bill from collect fees or assessments or exercise powers of eminent domain within a Water Quality Protection Zone until the zone has been annexed.
