LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session May 2, 1995 TO: Honorable John Whitmire, ChairIN RE: Senate Bill No. 1217 Committee on Criminal Justice By: Ellis Senate Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on Senate Bill No. 1217 (relating to notification of certain interest holders and owners of seized contraband in forfeiture proceedings under Chapter 59, Code of Criminal Procedure; providing that asset forfeiture is remedial in nature, rather than punitive) this office has determined the following: The bill would amend the Code of Criminal Procedure relating to forfeitures pursuant to Chapter 59. The bill establishes that asset forfeiture is remedial in nature and not punitive. The probable fiscal implication of implementing the provisions of the bill during each of the first five years following passage is estimated as follows: Fiscal Probable Revenue Year Loss to Controlled Substance Account 098 GR Consolidated 1996 $1,083,375 1997 1,083,375 1998 1,083,375 1999 1,083,375 2000 1,083,375 Similar annual fiscal implications would continue as long as the provisions of the bill are in effect.
