LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 74th Regular Session April 19, 1995 TO: Honorable Ken Armbrister, Chair IN RE: Senate BillNo. 1504 Committee on State Affairs By: Montford Senate Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on Senate Bill No. 1504 (Relating to the authority of political subdivisions to contract with the Department of Public Safety to assist in the enforcement of outstanding warrants of arrest for the failure to appear for certain traffic offenses, and authorizing the department to contract with a private vendor to facilitate such contracts.) this office has determined the following: The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill. The bill would authorize units of local government to assist he Department of Public Safety in the enforcement of certain outstanding traffic warrants for failure to appear. The bill would authorize the Department of Public Safety and units of local government to contract to facilitate this exchange of information. Additionally, the bill would authorize the DPS to contract with a vendor to facilitate the contracts with the units of local government. The bill authorizes the DPS to deny the renewal of a driver's license based upon a person's failure to appear. The bill authorizes units of local governments to collect an administrative fee of $30.00 for each violation for which the defendant failed to appear. Units of local government would retain $10.00 of each fee and remit the remaining $20.00 to the Comptroller of Public Accounts. The bill dedicates half of the state's revenue from the fee collections to the Department of Public Safety.
