Amend the Kubiak Amendment to CSHB 4 by striking the text of
the amendment and substituting the following:
      Amend CSHB 4 as follows:
      (1)  On page 373, line 12, strike "AND LIGNITE".
      (2)  On page 373, line 18, strike "includes" and substitute "
does not include lignite, commonly referred to as brown coal, of
intermediate grade between peat and bituminous coal".
      (3)  On page 373, strike lines 19-20.
      (4)  On page 373, line 21, strike "(3)" and substitute "(2)".
