Amend HB 40, SECTION 1, Sec. 103.004.  IMMUNITY FROM
DEFAMATION; EMPLOYER REPRESENTATIVES as follows:
      (a)  An employer who discloses information about a current or
former employee is immune from <civil> liability for defamation
based upon that disclosure or any damages proximately caused by
that disclosure unless it is proven by <clear and convincing> a
preponderance of the evidence that the information disclosed was
known by that employer to be false, or was made with reckless
disregard of whether it was false or not, at the time disclosure
was made.
