Amend CSHB 1188 by adding the following appropriately
numbered article of Chapter 5A, Revised Statutes, as added by
SECTION 3 of the bill and renumbering existing articles
appropriately:
      Art. 5A.    .  PROCEEDS USED FOR CHILD SUPPORT.  If the
borrower of an equity loan is delinquent in the payment of child
support for more than 30 days, as indicated by the records of the
Title IV-D agency, as defined by Section 101.033, Family Code,
proceeds of the loan may not be used for any other purpose until
the amount owed for child support is paid. Before delivering the
proceeds of the equity loan to the borrower or to another person on
the borrower's behalf, the lender shall deliver the amount owed for
child support to the Title IV-D agency for delivery to the person
owed the child support. The lender may then deliver the remainder
of the proceeds to the borrower or to another person on the
borrower's behalf, as provided by the equity loan agreement.
