Amend CSHB 1277 by striking page 3, line 24 through page 4,
line 3, and substituting the following:
      (e)  A customer who is delinquent in a minimum payment due on
an account in a periodic payment cycle is entitled to have the fees
and charges on the account that may be collected by the creditor
under this article, other than the finance charge, charged to a
separate account created and maintained for the customer by the
creditor.  If a separate account is created for a customer under
this subsection:
            (1)  the customer is liable for the total amount due on
the separate account;
            (2)  the customer is not required to begin making
payments on the separate account until the balance of the original
account is paid in full; and
            (3)  the creditor may charge a fee of not more than
five dollars a month for creating and maintaining the separate
account.  <Except as provided in Section (d) of this Article, as an
alternative to the rates authorized by Section (a)  of this
Article, the parties may agree to any rate not exceeding a rate
authorized by Article 1.04 of this Title.>
      (f)  No fees shall be charged to or collected from the
customer in connection with an account subject to this chapter
unless authorized by statute.
