Amend HB 1826 as follows:
SECTION 2.  Section 261.107, Family Code, is amended to read as
follows:
      Sec. 261.107.  FALSE REPORT; PENALTY.  (a) A person commits
an offense if the person knowingly or intentionally makes a report
as provided in this chapter that the person knows is false or lacks
factual foundation.  <An offense under this section is a Class A
misdemeanor.>  The first offense under this section is a Class A
misdemeanor; a subsequent offense under this section is a state
jail felony.
      (b)  A report under this section, which was made prior to or
during a suit affecting the parent-child relationship and in which
is contained accusations that the court determines the accuser knew
to be false or lacking factual foundation, may be grounds for the
court to modify the parent-child relationship to restrict further
access to the child by the accuser.
      (c)  The respective prosecuting attorney shall be responsible
for the prosecution of offenses under this section.
