Amend HB 2295 on third reading as follows:
      (1)  Strike SECTION 23 and substitute the following:
SECTION 23.  FACILITY ON COUNTY OR MUNICIPAL ROAD.  (a)  Section 16
of this act does not apply to an excavator by a county employee on
a county road or a municipal employee on a municipal road, except
an excavation within a recorded easement or an excavation in a
public right-of-way.
      (b)  This Act does not affect any contractual or statutory
right of a county or municipality to require an operator to
relocate, replace, or repair its underground facility.
