Amend CSHB 2909 by adding the following sections and
renumbering all sections accordingly:
      SECTION 1.  Amend Section 1(4) and add a new Section 1(5),
Article 4413(29ee), Revised Statutes, to read as follows:
            (4)  Except as provided in subsection 1(5),"Convicted"
means an adjudication of guilt or an order of deferred adjudication
entered against a person by a court of competent jurisdiction
whether or not:
                  (A)  the imposition of the sentence is
subsequently probated and the person is discharged from community
supervision; or
                  (B)  the person is pardoned for the offense,
unless the pardon is expressly granted for subsequent proof of
innocence.
            (5)  A person shall not be considered convicted within
the meaning of this Article if the person was pardoned or the
imposition of sentence was subsequently probated, the offense
charged did not involve violence, and the pardon or discharge of
terms of any probation or deferred adjudication occurred more than
25 years before application for the license.
      SECTION 2.  Renumber existing Section 1(5), Article
4413(29ee), Revised Statutes and all subsequent subsections after
Section 1 accordingly.
