Amend HB 3018 as follows:
      (1)  In SECTION 2 of the bill, in amended Article 2.12(29),
Code of Criminal Procedure, (senate committee printing, page 2,
line 35), after "Code;", strike "and".
      (2)  In SECTION 2 of the bill, in added Article 2.12(30),
Code of Criminal Procedure (senate committee printing, page 2, line
37, between "Code" and ".", insert "; and
            (31)  investigators commissioned by the Railroad
Commission of Texas under Section 81.021, Natural Resources Code".
      (3)  Insert the following appropriately numbered sections of
the bill:
      SECTION _____.  Subchapter B, Chapter 81, Natural Resources
Code, is amended by adding Section 81.021 to read as follows:
      Sec. 81.021.  INVESTIGATORS AS PEACE OFFICERS.  The
commission may commission investigators as peace officers to
investigate oil field thefts and related matters.  Not more than 11
investigators may hold a commission under this section at the same
time.
      SECTION _____.  415.035, Government Code, is amended by
adding Subsection (c) to read as follows:
      (c)  This section does not apply to the Railroad Commission
of Texas.
      SECTION _____.  Section 46.15, Penal Code, is amended to read
as follows:
      Sec. 46.15.  NONAPPLICABILITY TO CERTAIN PEACE OFFICERS.  (a)
Except as provide by Subsection (b), Sections 46.02 and 46.03 do
not apply to peace officers and neither section prohibits a peace
officer from carrying a weapon in this state, regardless of whether
the officer is engaged in the actual discharge of the officer's
duties while carrying the weapon.
      (b)  This section does not apply to a person commissioned by
the Railroad Commission of Texas under Section 81.021, Natural
Resources Code.
      (4)  Renumber the sections of the bill accordingly.
