Amend HB 3018 as follows:
(1) In SECTION 1 of the bill, in proposed Section
21.005(d)(1), Human Resources Code (Senate Committee Printing, page
1, line 18), strike "and".
(2) In SECTION 1 of the bill, in proposed Section 21.005(d),
Human Resources Code (Senate Committee Printing, page 1, between
lines 18 and 19), add a new Subdivision (2) to read as follows and
renumber current Subdivision (2) as (3):
(2) the agent obtains a license as a peace officer
from the Commission on Law Enforcement Officer Standards and
Education under Chapter 415, Government Code; and
(3) In SECTION 2 of the bill, in Subdivision (29) of amended
Article 2.12, Code of Criminal Procedure (Senate Committee
Printing, page 2, line 35), strike "and".
(4) In SECTION 2 of the bill, in amended Article 2.12, Code
of Criminal Procedure (Senate Committee Printing, page 2, between
lines 35 and 36), add a new Subdivision (30) to read as follows and
renumber current Subdivision (30) as (31):
(30) security personnel commissioned as peace officers
by a housing authority under Section 392.066, Local Government
Code; and
(5) Add the following appropriately numbered SECTION to the
bill and renumber existing SECTIONS of the bill accordingly:
SECTION ____. Subchapter D, Chapter 392, Local Government
Code, is amended by adding Section 392.066 to read as follows:
Sec. 392.066. SECURITY PERSONNEL; PEACE OFFICERS. (a) An
authority may employ security personnel and may commission its
security personnel as peace officers for the purpose of protecting:
(1) occupants of a housing project that is located in
the territorial boundaries of the authority and operated by the
authority; and
(2) the property of a housing project described by
Subsection (a)(1).
(b) The primary jurisdiction of a peace officer commissioned
under this section includes:
(1) the property of a housing project that is located
in the territorial boundaries of the authority and operated by the
authority; and
(2) the part of a public street or alley that is
contiguous to the property of a housing project described by
Subsection (b)(1) and that does not extend beyond the boundaries of
the property.
(c) In the peace officer's primary jurisdiction, a peace
officer commissioned under this section:
(1) has all the powers, privileges, and immunities of
a peace officer;
(2) may, in accordance with Chapter 14, Code of
Criminal Procedure, arrest without a warrant a person who violates
a law of the state; and
(3) may enforce all traffic laws on streets and
highways.
(d) Outside a peace officer's primary jurisdiction, a peace
officer commissioned under this section has the powers, privileges,
and immunities of a peace officer and may arrest a person who
violates a law of the state if the peace officer:
(1) is summoned by another law enforcement agency to
provide assistance; or
(2) is assisting another law enforcement agency.
(e) A person employed as security personnel may not be
commissioned as a peace officer under this section unless the
person obtains a license as a peace officer from the Commission on
Law Enforcement Officer Standards and Education under Chapter 415,
Government Code.
