Amend CSHB 3459 by adding a new SECTION 4 to the bill to read
as follows and appropriately renumbering subsequent sections of the
bill:
      SECTION 4.  The Texas Environmental, Health, and Safety Audit
Privilege Act (Article 4447cc, Vernon's Texas Civil Statutes) is
amended by adding Section 8A to read as follows:
      Sec. 8A.  LIMITATION ON USE OF PRIVILEGE BY FEDERAL
AGENCIES:  The privilege provided in this law does not apply to
facilities owned or operated by the federal government.
