Amend CSSB 1 as follows:
      (1)  In SECTION 1.02 of the bill, proposed Subsection
(e)(4)(I), Section 16.053, Water Code  (Committee Printing, page 5,
line 26), strike "nonmunicipal use" and substitute "other than
domestic or municipal use".
      (2)  In SECTION 1.02 of the bill, proposed Subsection
(e)(4)(I), Section 16.053, Water Code (Committee Printing, page 6,
line 1), strike "the nonmunicipal water rights holder" and
substitute ", or unreasonable economic loss to, the holder of the
permit,  certified filing, or certificate of adjudication for other
than domestic or municipal use".
      (3)  In SECTION 3.03 of the bill, amended Section 11.139,
Water Code, between Subsections (h) and (i) (Committee Printing,
page 49, between lines 17 and 18), insert the following subsections
and reletter the subsequent subsections appropriately:
      (i)  The executive director or the commission, in determining
the part of a permit, certified filing, or certificate of
adjudication for other than domestic or municipal use to be
temporarily transferred under this section, shall consider the
information concerning emergency transfers included in the regional
water plan under Section 16.053(e)(4)(I).
      (j)  The executive director or the commission may not
transfer an amount of water that would result in unreasonable
damage to property of, or unreasonable economic loss to, the holder
of the permit, certified filing, or certificate of adjudication
from which water is to be transferred.
      (k)  If transferring the amount of water requested by the
applicant would cause unreasonable property damage or unreasonable
economic loss, the executive director or the commission shall
allocate the requested amount among two or more permits, certified
filings, or certificates of adjudication for other than domestic or
municipal use.
