Amend SB 27 as follows: (1) In SECTION 1 of the bill, in the last sentence of Subsection (c) of added Section 20.02, Business & Commerce Code (committee report, page 3, line 44), between "agency" and the period, add "unless the person has reason to believe that the social security number is inaccurate". (2) In SECTION 1 of the bill, in Subsection (a) of added Section 20.03, Business & Commerce Code (committee report, page 3, lines 56-58), strike Subdivision (3) and substitute the following: (3) if the consumer reporting agency compiles and maintains files on a nationwide basis, a toll-free number at which personnel are available to consumers during normal business hours for use in resolving a dispute if the consumer submits a written dispute to the consumer reporting agency. (3) In SECTION 1 of the bill, in Subsection (a) of added Section 20.04, Business & Commerce Code (committee report, page 4, line 4), after the last sentence, add the following: On January 1 of each year, a consumer reporting agency may increase the charge for disclosure to a consumer. The increase, if any, must be based proportionally on changes to the Consumer Price Index with fractional changes rounded to the nearest 50 cents. (4) In SECTION 1 of the bill, in the last sentence of Subsection (a) of added Section 20.06, Business & Commerce Code (committee report, page 4, line 68), between "agency" and the period, add "during normal business hours". (5) In SECTION 1 of the bill, in Subsection (b) of added Section 20.06, Business & Commerce Code (committee report, page 5, lines 2-5), strike ", unless otherwise directed by the consumer," and strike "and each person requesting information about the consumer". (6) In SECTION 1 of the bill, in Subsection (f)(6) of added Section 20.06, Business & Commerce Code (committee report, page 5, line 51), strike "is" and substitute "may be". (7) In SECTION 1 of the bill, in Subsection (a) of added Section 20.07, Business & Commerce Code (committee report, page 5, lines 61-62), strike "by speaking directly to a representative of the agency or". (8) In SECTION 1 of the bill, in Subsection (b) of added Section 20.07, Business & Commerce Code (committee report, page 5, lines 64-69), strike subsection (b) and insert: "The credit reporting agency which receives a correction shall have reasonable procedures to assure that previously reported inaccurate information in a consumer's file is corrected in a prompt and timely fashion." (9) In SECTION 1 of the bill, in Subsection (a) of added Section 20.08, Business & Commerce Code (committee report, page 6, line 5), between "or" and "may", insert ", if agreed to by both parties,". (10) In SECTION 2 of the bill (committee report, page 6, line 65), strike "September" and substitute "October".
