Amend SB 353 as follows:
      (1)  Between Sections 10 and 11 of the bill (house committee
printing,  page 9, between lines 14 and 15), insert the following
appropriately numbered section:
      SECTION ____.  Section 432.109(g), Government Code, is
amended to read as follows:
      (g)  An accused <, not later than the 60th day after the date
he receives actual notice of the final action on his case,> may
petition the Texas Court of Military Appeals for review of a
court-martial conviction<. The court shall act on the petition> not
later than the 60th day after the date the accused or the accused's
counsel is notified of the final action on the accused's case,
whichever date is earlier <the petition is received>.  If the court
fails or refuses to grant the petition for review, the final action
of the convening authority is considered approved.  If the court
grants a petition for review <Notwithstanding any other provision
of this chapter, on the court granting a hearing of an appeal>, the
court may grant a stay or defer service of the sentence of
confinement or any other punishment under this chapter until the
court's final decision on the case.
      (2)  Renumber sections of the bill accordingly.
