Amend SB 361 as follows:
      (1)  Inserting the following as SECTION 1, and renumbering
the remaining Sections accordingly:
      SECTION 1.  Section 6.02, Medical Practice Act (Article
4495b, Vernon's Texas Civil Statutes) is amended to read as
follows:
            Sec. 6.02.  In this subchapter:
                  (1)  "Acupuncture" means:
                        (A)  the nonsurgical, nonincisive insertion
of an acupuncture needle and the application of moxibustion to
specific areas of the human body as a primary mode of therapy to
treat and mitigate a human condition; and
                        (B)  the administration of thermal or
electrical treatments or the recommendation of dietary guidelines,
energy flow exercise, or dietary or herbal supplements in
conjunction with the treatment described by Paragraph (A) of this
subdivision.
                  (2)  "Acupuncturist" means a person who practices
acupuncture.
                  (3)  "Acupuncture board" means the Texas State
Board of Acupuncture Examiners.
                  (4)  "Chiropractor" means a licensee of the Texas
Board of Chiropractic Examiners.
                  (5)  "Executive director" means the executive
director of the Texas State Board of Medical Examiners.
                  (6)  "Medical board" means the Texas State Board
of Medical Examiners.
                  (7)  "Physician" means a licensee of the Texas
State Board of Medical Examiners.
