Amend CSSB 370 by adding a new section to Article 7 of the
bill, appropriately numbered, to read as follows and renumbering
subsequent sections of the bill appropriately:
      SECTION 7.____.  (a)  If the Texas Department of
Transportation is authorized to construct an intermodal toll road
inclusive of a freight rail line that is to be part of the state
highway system:
            (1)  in selecting the route for the intermodal toll
road, the department must give consideration for the character of
the land along the proposed route of the toll road and its
suitability for particular uses; and
            (2)  if the route is to be selected from among more
than one alternative route, the department must give consideration
for the character of the land along each alternative route and its
suitability for particular uses.
