Amend SB 370, on third reading, by adding a new section to
Article 7 of the bill, appropriately numbered, to read as follows
and renumbering subsequent sections of the bill appropriately:
      SECTION 7.____.  (a)  If the Texas Department of
Transportation is authorized to construct an intermodal toll road
inclusive of a freight rail line that is to be part of the state
highway system, and if the toll road is constructed as a result of
a trade agreement between the United States and foreign countries
to relieve congestion on U.S. Interstate Highway 35, no portion of
the toll road may be constructed within one mile of an existing
public elementary or secondary school in this state that is within
250 miles of an international border crossing.
      (b)  Subsection (a) of this section takes effect on the first
day of the calendar month following the date on which the Texas
Transportation Commission determines that implementation of
Subsection (a) will not result in the loss of highway-related funds
from the federal government. The commission shall endeavor to make
such determinations as soon as practicable.
