Amend the Naishtat amendment to CSSB 1253 as follows:
      (1) On page 1, line 7, after "JURISDICTION.", insert "(a)"
      (2) On page 1, between lines 21 and 22 insert the following:
      (b) A protective order defined by subsection (a) of this
section does not include a protective order issued by a
jurisdiction to protect one or more domestic partners if:
            (1) the domestic partner laws of the jurisdiction which
issues the protective order are contrary to the requirement that a
marriage be comprised of one man and one woman pursuant to:
                  (A) Section 2.001, Family Code;
                  (B) Section 2.401(a), Family Code; and
                  (C) the public policy in the State of Texas to
repudiate same-sex marriage; and
            (2) the protective order was issued to a domestic
partner of a marriage of persons of the same sex.
      (3) On page 2, between lines 21 and 22, insert the following:
      (d) A protective order under this section does not include a
protective order issued by a jurisdiction to protect one or more
domestic partners if:
            (1) the domestic partner laws of the jurisdiction which
issues the protective order are contrary to the requirement that a
marriage be comprised of one man and one woman pursuant to:
                  (A) Section 2.001, Family Code;
                  (B) Section 2.401(a), Family Code; or
                  (C) the public policy in the State of Texas to
repudiate same-sex marriage; and
            (2) the protective order was issued to a domestic
partner of a marriage of persons of the same sex.
      (4) On page 3, between lines 14 and 15, insert the following:
      (c) A protective order under this section does not include a
protective order issued by a jurisdiction to protect one or more
domestic partners if:
            (1) the domestic partner laws of the jurisdiciton which
issues the protective order are contrary to the requirement that a
marriage be comprised of one man and one woman pursuant to:
                  (A) Section 2.001, Family Code;
                  (B) Section 2.401(a), Family Code; or
                  (C)  the public policy in the State of Texas to
repudiate same-sex marriage; and
            (2) the protective order was issued to a domestic
partner of a marriage of persons of the same sex.
