Amend SB 1539, in SECTION 7 of the bill, in amended
Section 42.072, Human Resources Code (Committee printing, page 32,
after line 25), by inserting the following:
      (e)  A person may continue to operate a facility or family
home during an appeal of a license or registration denial or
revocation unless the denial or revocation is based on a violation
that poses a risk to the health or safety of children. The
department by rule shall establish the violations that pose a risk
to the health or safety of children. The department shall notify a
facility or family home of a violation by the facility or home that
poses a risk to the health or safety of children requiring that the
facility or home cease operating. A person who has been notified by
the department that the facility or home may not operate under this
subsection is entitled to seek injunctive relief from a district
court to permit operation during the appeal.  The court may grant
injunctive relief permitting the facility or home to operate if the
court finds that the operation does not pose a risk to the health
or safety of children.
