DIGEST 

Currently, there are no provisions requiring a declaration of write in
candidacy in an election for the members of the governing body of a junior
college district or the board of a hospital district.  H.B. 51 sets forth
the criteria for write-in voting for members of the governing body of a
junior college or a hospital district. 

PURPOSE

As proposed, H.B. 51 sets forth the criteria for write-in voting for
members of the governing body of a junior college district or a hospital
district. 

RULEMAKING AUTHORITY

Rulemaking authority is granted to the secretary of state under SECTIONS 1
and 2 (Sections 130.0825(f) and 285.131(f), Education Code) of this bill. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 130E, Education Code, by adding Section
130.0825, as follows: 

Sec.  130.0825.  WRITE-IN VOTING IN ELECTION FOR MEMBERS OF GOVERNING
BODY.  Sets forth the conditions for write-in candidates for a general or
special election for members of the governing body of a junior college
district.  Provides that Chapter 146B, Election Code, applies to write-in
voting in an election for members of the governing body except to the
extent of a conflict with this section.  Requires the secretary of state
to adopt rules necessary to implement this section.   

SECTION 2. Amends Chapter 285, Health and Safety Code, by adding
Subchapter J, as follows: 

SUBCHAPTER J.  WRITE-IN VOTING IN ELECTION FOR BOARD MEMBERS

Sec.  285.131.  WRITE-IN VOTING IN ELECTION FOR BOARD MEMBERS.  Sets forth
the conditions for write-in candidates for a general or special election
for board members of a hospital district created under general or special
law.  Makes conforming changes. 

SECTION 3. Effective date:  September 1, 1997.

SECTION 4. Emergency clause.
