ACM H.B. 133 75(R)BILL ANALYSIS CRIMINAL JURISPRUDENCE H.B. 133 By: Hochberg 4-14-97 Committee Report (Unamended) BACKGROUND Section 49.01, Penal Code, defines intoxication as "having an alcohol concentration of 0.10 or more." PURPOSE HB 133, as proposed, would lower the alcohol concentration at which a driver is legally intoxicated to 0.08. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 49.01(2), Penal Code, Definitions, to define "intoxicated" as "having an alcohol concentration of 0.08 or more." SECTION 2. The change in law made by this Act applies only to an offense committed on or after the effective date of this Act. SECTION 3. Effective Date: September 1, 1997. SECTION 4. Emergency Clause.
