JWW H.B. 171 75(R)BILL ANALYSIS PUBLIC SAFETY H.B. 171 By: Driver 3-6-97 Committee Report (Unamended) BACKGROUND Currently the offense of knowingly providing false information on the application for a Texas driver's license or personal identification card is a class B or C misdemeanor. However, this same offense, tampering with a government record, is a class A misdemeanor under Section 37.10, Penal Code. PURPOSE This bill will make an offense under Section 521.454, Transportation Code, a class A misdemeanor. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1 Section 521.454(c), Transportation Code is amended to make any offense under this section a class A misdemeanor. It removes all language making any offense a class B or C misdemeanor. SECTION 2 This bill applies only to offenses committed after the effective date. All offenses committed before the effective date are subject to the former law. SECTION 3 Effective Date: September 1, 1997 SECTION 4 Emergency Clause
