SRC-MAX H.B. 209 75(R) BILL ANALYSIS Senate Research Center H.B. 209 By: Puente (Luna) State Affairs 5-12-97 Engrossed DIGEST Surviving spouses of deceased members of the Teacher Retirement System of Texas were not allowed to receive monthly survivor benefits upon remarrying, prior to 1980. In 1980, the law changed to allow surviving spouses to be eligible to receive benefits upon remarriage, but failed to include surviving spouses who had remarried prior to 1980. This bill provides retroactive payment to any survivor whose benefits were foregone by the old marriage provision. PURPOSE As proposed, H.B. 209 sets forth monthly benefits for surviving spouses of deceased members of the Teacher Retirement System of Texas. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 824.4041(b), Government Code, to set forth the Teacher Retirement System of Texas' system of determination of eligibility of benefits and payment formulas. Makes a conforming change. SECTION 2. Emergency clause. Effective date: upon passage.
