BWH C.S.H.B. 236 75(R)BILL ANALYSIS COUNTY AFFAIRS C.S.H.B. 236 By: Solomons 3-26-97 Committee Report (Substituted) BACKGROUND Large counties, with a population of 250,000 or more, must impanel jurors in a central location. After these jurors are impaneled in a central location, they are required to travel to courts all over the county. Many of these jurors have to drive more than 10 miles to the location where they will serve on a jury. PURPOSE This legislation provides jurors with relief from returning to the place of appearance, if the juror has traveled more than 10 miles on that day. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 62.016, Government Code by adding a new Subsection (k) to provide that a juror does not have to return to the place of appearance if they traveled more than 10 miles to the place where the proceedings are held. SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE In CSHB 236, the following changes from the original bill are made: 1) SECTIONS 1 and 2 of the original have been deleted; 2) The substitute adds a new SECTION 1. which amends Section 62.016, Government Code by adding subsection (k) to provide that a juror does not have to return to the place of appearance if they traveled more than 10 miles to the place where the proceedings are held; and 3) Renumbers SECTIONS 3 and 4 of the original accordingly.
