SRC-JRN, JRN H.B. 462 75(R) BILL ANALYSIS Senate Research Center H.B. 462 By: Zbranek (Nixon) Criminal Justice 5-12-97 Engrossed DIGEST Currently, Texas law allows a district attorney to maintain an independent law practice for supplementary pay, unless the district attorney is listed in the Professional Prosecutors Act, which provides additional state funding to supplement existing salaries in exchange for prohibiting the prosecutor from the private practice of law. The district attorney from the 88th Judicial District is not included in the Professional Prosecutors Act. This bill deletes provisions requiring the state to supplement the salary of the district attorney of the 88th Judicial District. PURPOSE As proposed, H.B. 462 deletes provisions requiring the state to supplement the salary of the district attorney of the 88th Judicial District. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 46.002, Government Code, to set forth districts for prosecutors that are subject to this chapter, including the 88th Judicial District. SECTION 2. Amends Section 43.144, Government Code, to delete a provision authorizing the commissioners court of Hardin County to supplement the state salary of the district attorney. SECTION 3. Effective date: September 1, 1997. SECTION 4. Emergency clause.
