Committee Report (Substituted)

BACKGROUND

Health and Safety Code Section 368.012 allows counties with a population
of 100,000 people or less the ability to license waste haulers not
exempted in Section 368.013. Without the ability to license waste
haulers, larger counties have been unable to control illegal dumping on
county land.

PURPOSE

This bill changes the population restriction in Section 368.012 to give
counties with a population of less than 375,000 the authority to license
waste haulers not exempted in Section 368.013.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution.
