ACG C.S.H.B. 473 75(R)BILL ANALYSIS ENVIRONMENTAL REGULATION C.S.H.B. 473 By: Howard 3-18-97 Committee Report (Substituted) BACKGROUND Health and Safety Code Section 368.012 allows counties with a population of 100,000 people or less the ability to license waste haulers not exempted in Section 368.013. Without the ability to license waste haulers, larger counties have been unable to control illegal dumping on county land. PURPOSE This bill changes the population restriction in Section 368.012 to give counties with a population of less than 375,000 the authority to license waste haulers not exempted in Section 368.013. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 368.012 of the Health and Safety Code by changing the population minimum from 100,000 to 375,000. SECTION 2. Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE HB 473 removes the population restriction of 100,000. CSHB 473 changes the population restriction from 100,000 to 375,000.
