BWH H.B. 501 75(R)BILL ANALYSIS COUNTY AFFAIRS H.B. 501 By: Woolley 3-12-97 Committee Report (Unamended) BACKGROUND Section 791.012 of the Texas Government Code states that local governments that are parties to an inter-local contract for the performance of a service may, in performing the service, apply the local law of a party as agreed by the parties. However, general law cities follow state law with respect to the purchase of goods and services, so there is no local law to apply. PURPOSE This bill clarifies the language of Sec. 791.012 Texas Government Code, as it applies to the law which governs inter-local contracts. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends the wording of Sec. 791.012 Texas Government Code by striking "local" thereby expanding the law which is applicable to interlocal contracts. SECTION 2. Emergency clause. Effective upon passage.
