DIGEST 

Currently, Section 30.04, Penal Code, provides that burglary of a vehicle
is a Class A misdemeanor. H.B. 521 would enhance the punishment to a state
jail felony if at the trial it is determined that the defendant has been
previously convicted of burglary of a vehicle. 

PURPOSE

As proposed, H.B. 521 outlines provisions regarding punishment for the
offense of burglary of a vehicle. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 30.04(c), Penal Code, to provide that an offense
under this section is a Class A misdemeanor unless it is shown on the
trial of the offense that the defendant has been previously convicted of
an offense under this section, in which event the offense is a state jail
felony. 

SECTION 2. Makes application of this Act prospective.

SECTION 3. Effective date: September 1, 1997.

SECTION 4. Emergency clause.
