Page HB 522CJ H.B. 522 75(R)BILL ANALYSIS JUVENILE JUSTICE & FAMILY ISSUES H.B. 522 By: Thompson 2-21-97 Committee Report (Unamended) BACKGROUND Section 106.001, Family Code, provides that in parent-child suits costs be awarded in the same manner as costs in other civil cases. In other civil cases costs are awarded to a prevailing party. In parent-child suits there is often not a clearly prevailing party. PURPOSE The purpose of this bill is to allow the court to award costs in parent-child suits without determining a prevailing party. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION-BY-SECTION ANALYSIS SECTION 1. Amends Section 106.001, Family Code, to remove the provision that costs awarded in parent-child suits be awarded in the same manner as costs in other civil cases. SECTION 2. Amends Section 106.002(a), Family Code, to make this section apply to all suits under Title 5. SECTION 3. Amends section 152.007(g), Family Code, to make a conforming amendment. SECTION 4.
