JUVENILE JUSTICE & FAMILY ISSUES
H.B. 522
By: Thompson
2-21-97
Committee Report (Unamended)

BACKGROUND

Section 106.001, Family Code, provides that in parent-child suits costs
be awarded in the same manner as costs in other civil cases. In other
civil cases costs are awarded to a prevailing party. In parent-child suits
there is often not a clearly prevailing party.

PURPOSE

The purpose of this bill is to allow the court to award costs in
parent-child suits without determining a prevailing party.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution.
