BACKGROUND 

 When the Super Conducting Super Collider project was cancelled by the
Congress of the United States, the Department of Energy titled parcels of
land to various political sub-divisions. The actual lab site was given to
Ellis County in leu of cash reimbursements.  In order to liquidate such a
limited use facility, Ellis County Commissioners Court has asked that, in
dealing with Super Collider property owned by Ellis County, the
Commissioners Court be allowed to determine the method of disposal.  This
would allow flexibility in negotiation. 

PURPOSE

To allow property formerly used in conjunction with the Super Conducting
Super Collider to be waved from the Local Government Code bid process
established for disposal of property.  

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 270 of the local Government Code by:
 1)  adding a new Section 270.008(a) allowing a commissioners court to
determine the method of disposal of  Super Conducting Super Collider that
is owned by a county; and 

 2) adding a new Sec. 270.008(b) which exempts a commissioners court from
being required to follow the bid process established for disposal of
property under Sections 263.001 or 272.001, Local Government Code when the
property was used in conjunction with the Super Conducting Super Collider. 
 
SECTION 2.  Emergency clause.
