JJG H.B. 566 75(R)BILL ANALYSIS ECONOMIC DEVELOPMENT H.B. 566 By: Oliveira 2-19-97 Committee Report (Unamended) BACKGROUND In an attempt to collect money owed the State such as taxes, child support payments and student loans, the Texas Lottery Commission is authorized to deduct from the winnings of an individual, certain moneys determined to be delinquent. Those currently reporting delinquencies to the Lottery Commission include the Comptroller of Public Accounts, the Texas Alcoholic Beverage Commission, the Attorney General's Office and the Texas Guaranteed Student Loan Corporation. The Texas Workforce Commission is responsible for the collection of unemployment taxes and various fees. Occasionally those responsible for payment become delinquent. PURPOSE H.B. 566 would add the Texas Workforce Commission to the list of agencies reporting delinquencies to the Texas Lottery Commission and would require the Lottery Commission to deduct delinquent amounts from winnings. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 466.407(a) and (c) of the Government Code to add the Texas Workforce Commission to the list of agencies required to report to the Texas Lottery Commission those persons who are delinquent in payments owed the State and requires the Texas Lottery Commission to deduct delinquencies from lottery winnings.
