SRC-JRN H.B. 574 75(R) BILL ANALYSIS Senate Research Center H.B. 574 By: Hawley (Truan) Natural Resources 5-15-97 Engrossed DIGEST Currently, the offices of the San Patricio Navigation District No. 1 are located in Aransas Pass, Texas, while the offices of the county treasurer of San Patricio County are located in Sinton, Texas. It is difficult for the San Patricio Navigation District to comply with the provisions established in Chapter 62, Water Code. This bill waives the requirements as established in Chapter 62, Water Code, for the San Patricio Navigation District No. 1. PURPOSE As proposed, H.B. 574 waives the requirements as established in Chapter 62, Water Code, for the San Patricio Navigation District No. 1. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. TREASURER. Authorizes the commissioners of San Patricio County Navigation District No. 1 by resolution to appoint a qualified individual or financial institution to serve as treasurer of the district, notwithstanding Section 62.073, Water Code. Provides that a district treasurer appointed by the commissioners as authorized by this Act has the powers and duties of a county treasurer under Chapter 62, Water Code, except as provided by this Act. SECTION 2. DISBURSEMENT OF MONEY. Authorizes, Sections 62.152 and 62.153, notwithstanding, the commissioners of the San Patricio County Navigation District No. 1 by resolution to authorize one or more persons in addition to the treasurer to sign certain instruments for the disbursement of the district's money. Authorizes the district's money to be disbursed only by a check, draft, order, or other instrument signed by the treasurer or by another person or persons authorized by resolution of the commissioners. Authorizes the commissioners of the San Patricio County Navigation District No. 1 to limit the authority of a person authorized by the commissioners under Subsection (a) to sign a check, draft, order, or other instrument and to require the person to furnish a fidelity bond in an amount specified by the commissioners. SECTION 3. TRANSITION. Provides that the San Patricio County treasurer is the district treasurer and has the powers and duties of a county treasurer acting as district treasurer under Chapter 62, Water Code, until the commissioners of the San Patricio Navigation District No. 1 appoint a district treasurer as authorized by Section 1 of this Act and that person has executed any bond required by Section 62.074, Water Code. Requires the San Patricio County treasurer to transfer to the district treasurer the district's funds immediately after the commissioners of the San Patricio Navigation District No. 1 have appointed a district treasurer as authorized by Section 1 of this Act and the treasurer has executed any bond required by Section 62.074, Water Code. SECTION 4. Effective date: September 1, 1997. SECTION 5. Emergency clause.
