BACKGROUND 

After World War II, local municipalities in the Rio Grande Valley either
donated land, or sold land at prices below actual market values to assist
the Texas National Guard perform its duty to our nation. In 1993, the
Texas National Guard Armory Board approved the creation of a "Super
Armory" in the Rio Grande Valley.  As a result, armories in the Valley
were abandoned by the Texas National Guard in order to combine the troops
and equipment at this new "Super Armory." 

PURPOSE

HB 616, this bill provides for the transfer of certain state properties
from the Texas National Guard Armory to specific municipalities.  These
transferred properties may only be utilized for governmental purposes. 

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Provides for the donation and transfer of real property from
the National Guard Armory Board to the City of Donna. 

 (a) states the property can only be transferred if it meets certain
conditions: 
  (1) is no longer in use by the National Guard
  (2) is fully paid for and free of liens
  (3) all obligations incurred in connection with the acquisition and
construction of   the property have been fully paid. 

 (b)  Requires the National Guard Armory Board to transfer the property by
an appropriate instrument of transfer with a provision that the City of
Donna may only use the property for governmental purposes. 

 (c) Establishes that the Texas National Guard Armory Board shall maintain
in its custody, the instrument of transfer, after its filing. 

 (d) Describes the real property to be conveyed, with exception for
mineral rights. 

SECTION 2.  Provides for the donation and transfer of real property from
the National Guard Armory Board to the City of Edinburg. 

SECTION 3.  Provides for the donation and transfer of real property from
the National Guard Armory Board to the City of McAllen. 

SECTION 4.  Provides for the donation and transfer of real property from
the National Guard Armory Board to the City of Pharr. 

SECTION 5.  Emergency clause.  Effective date.
