CPC H.B. 630 75(R)BILL ANALYSIS LAND & RESOURCE MANAGEMENT H.B. 630 By: Yarbrough 5-2-97 Committee Report (Unamended) BACKGROUND Texas has seen problems in the urban areas and the surrounding counties of its largest cities with sexually oriented businesses opening in areas that are not zoned. Changes are being made throughout the Codes and Statutes relating to distance of the location of these types of establishments. PURPOSE CSHB 630 will amend Section 243.006 of the Local Government Code by adding subsection (c). This new subsection will give the governing authority in a municipality or a county the authority to adopt regulations of distance for a sexually oriented business. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sec. 243.006, Local Gov. Code, by adding subsection (c) as follows: (c) provides that a municipality or county, in addition to any other regulation adopted under this chapter, the authority to regulate the location of a sexually oriented business within 1500 feet of a public or private school, a church or other regular places of worship, a park, a playground or athletic field, a day care or child care center, an adult care center, a hospital or nursing facility, or an area determined by the governing body of the municipality or county, that is used primarily as a residential neighborhood.
