DIGEST 

Currently, the Texas Historical Commission does not use the services of
nonprofit historical organizations to assist in efforts to obtain
charitable gifts.   It is believed that many potential donors are
reluctant to give directly to state government but are willing to make
contributions to 501(c)(3) tax exempt organizations that assist state
agencies.  This bill would allow the commission to accept and use funds
provided by nonprofit or volunteer organizations.     

PURPOSE

As proposed, H.B. 726 allows the Texas Historical Commission to accept and
use funds and services provided by nonprofit or volunteer organizations. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 442.005(p), Government Code, to authorize the
Texas Historical Commission (commission) to accept services or property to
carry out any purpose of this chapter, including funds raised or services
provided by a volunteer or volunteer group to promote the work of the
commission.   Authorizes the commission to participate in the
establishment and operation of an affiliated nonprofit organization whose
purpose is to raise funds for or provide services or other benefits to the
commission. 

SECTION 2. Effective date:  September 1, 1997.

SECTION 3. Emergency clause.
