NDT H.B. 743 75(R)BILL ANALYSIS LICENSING & ADMINISTRATIVE PROCEDURES H.B. 743 By: Goolsby 3-17-97 Committee Report (Unamended) BACKGROUND Participating in games where the primary purpose of the game is the consumption of alcoholic beverages can be extremely dangerous. Drinking games contribute to potentially hazardous situations such as driving under the influence and can even lead to alcohol poisoning or death. PURPOSE HB 743 would regulate the arranging, conducting or participating in certain drinking games. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1: Amends subchapter D, Chapter 101 of the Alcoholic Beverage Code by adding Section 101.76. Section 101.76. CERTAIN DRINKING GAMES PROHIBITED. (a) A person commits an offense if the person arranges, conducts, or participates in a game if: (1) An element of the game includes the consumption of alcoholic beverages. (2) The primary purpose of the game is the intoxication of the participants. (b) An offense under this section is a Class C misdemeanor. SECTION 2: Effective date: September 1, 1997. SECTION 3: Emergency clause.
